Welcome to TravelQ. These Terms of Use ("Terms") govern your access to and use of the TravelQ mobile app, travelq.com.br website, and related services (the "Service"). Please read carefully — by using the Service, you agree to these Terms.
1. Acceptance
By creating an account, downloading, or using the app, you confirm you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service. You must be at least 13 years old; users under 18 need parental consent.
2. Description of the Service
TravelQ is a digital travel companion offering:
- AI-assisted personalized itinerary creation;
- Apple Maps integration for routes and places;
- Expense tracking and splitting among travelers;
- Trip sharing with friends and family;
- Achievement and gamification system.
The Service may evolve, including new features or discontinuing others, without prior notice.
3. Your account
- You are responsible for keeping credentials confidential.
- You are responsible for all activity under your account.
- Account information must be true, accurate, and up to date.
- Notify us immediately of unauthorized use.
- You can delete your account anytime in the app (Settings → Account → Delete).
4. Acceptable use
You agree not to:
- Use the Service for unlawful, fraudulent, or harmful purposes;
- Violate third-party rights, including IP and privacy;
- Reverse engineer, decompile, or extract source code;
- Use bots, scrapers, or automated means;
- Overload or interfere with our infrastructure;
- Post offensive, discriminatory, threatening, or hateful content;
- Impersonate another person or entity;
- Resell, sublicense, or commercially exploit the Service without authorization.
5. User content
You retain ownership of all content you create on the Service. By posting content, you grant us a limited, non-exclusive, worldwide, royalty-free license to store, process, and display it solely to operate the Service. You are responsible for the rights to the content you post. We may remove content that violates these Terms or applicable laws.
6. AI features
- We do not guarantee the absolute accuracy of AI suggestions.
- We are not liable for travel decisions based solely on Service suggestions.
- Content you paste or submit may be processed by third-party AI models (OpenAI, Anthropic) as described in the Privacy Policy.
7. Payments and subscriptions
Some features may require a paid subscription. In-app purchases are processed by Apple (App Store) under Apple's terms.
- Subscriptions auto-renew unless canceled at least 24 hours before period end.
- Manage and cancel in Settings → Apple ID → Subscriptions.
- Refunds are handled by Apple per their policy.
- Prices may vary by region and may change with 30 days' notice.
8. Intellectual property
All Service content (design, code, brand, logos, interfaces) is owned by TravelQ or licensed, protected by Brazilian Copyright Law (9.610/1998) and Industrial Property Law (9.279/1996). Reproduction without express authorization is prohibited.
9. Limitation of liability
The Service is provided "as is". To the maximum extent permitted by law:
- We do not guarantee uninterrupted or error-free availability.
- We are not liable for indirect, consequential, or lost-profit damages.
- We are not liable for delays, cancellations, or issues with flights, hotels, or travel providers — we are a planning tool, not a travel agency.
- Our total liability is limited to amounts paid by you in the last 12 months.
Nothing in these Terms limits rights that cannot be excluded by law (Brazilian Consumer Code).
10. Termination
- You may close your account at any time.
- We may suspend or terminate your account for violations, with reasonable notice when possible.
- IP, confidentiality, and liability clauses survive termination.
11. Governing law and venue
These Terms are governed by the laws of the Federative Republic of Brazil. The consumer's home jurisdiction is the elected forum for disputes, under the Brazilian Consumer Code.
12. Apple-specific terms
When you download from the App Store, you also accept Apple's EULA. Additionally:
- Apple is not a party to this contract and has no obligation to provide support.
- TravelQ, not Apple, is solely responsible for the Service.
- Your sole remedy via App Store for defects is a refund of the purchase price, if applicable.
- Apple is a third-party beneficiary of these Terms and may enforce them.
